SALISBURY, N.C. – The driver charged in connection with a crash that claimed three lives in Salisbury is now being held in the Rowan County Detention Center under an Immigration and Customs Enforcement, or ICE, detainer, according to county jail records.
Javiel Pena Sola, 42, was transferred to the Rowan County Detention Center following his release from a hospital, where he was treated for injuries sustained in the July 18 crash on N.C. 150 near Town Court. Jail records show he is being held on three counts of felony hit and run involving serious injury or death with no bond and an active ICE hold.
The Salisbury Police Department said officers responded to the two-vehicle collision at approximately 10:45 p.m. Three occupants of one vehicle suffered critical injuries. Two were pronounced dead at the scene, and a third later died after being airlifted to a hospital.
Investigators said the second vehicle left the roadway and came to rest in a creek bed. With assistance from the Cabarrus County Sheriff’s Office K-9 Unit, officers located Pena Sola in the nearby area. He was initially taken to Novant Health Rowan Medical Center before being transferred to a Charlotte-area hospital for additional treatment.
Following the preliminary investigation, Salisbury police charged Pena Sola with three counts of felony hit and run involving serious injury or death. Police have said additional charges remain possible as the investigation continues.
An ICE detainer requests that a local jail notify federal immigration authorities before an inmate is released so agents have an opportunity to assume custody. The detainer is separate from the pending state criminal charges and does not determine the outcome of either the criminal case or any immigration proceedings.
