WINSTON-SALEM, N.C. — Both parents of a 1-month-old boy who died after being exposed to methamphetamine last year are now facing criminal charges, more than a year after the child’s death.
James Anthony Kirby, 47, was charged Monday, Oct. 19, with misdemeanor child abuse and contributing to the delinquency of a juvenile, according to court documents.
The charges came nearly two weeks after the child’s mother, Taylor Marie Allman, 28, was charged in connection with the same case.
The infant died Oct. 12, 2025, in Winston-Salem. Testing conducted after his death found methamphetamine in his system.
According to court documents, Allman kept her baby in a home where methamphetamine was being sold. She was charged with misdemeanor child abuse, contributing to the delinquency of a juvenile and two felony counts of trafficking methamphetamine.
Allman received a $250,000 bond and remained in the Forsyth County jail as of Tuesday.
Investigators also alleged Kirby used and sold methamphetamine while caring for his infant son.
Kirby received a $5,000 bond on the two new misdemeanor charges. He was already being held in jail on separate felony charges involving methamphetamine trafficking and possession of a stolen firearm.
Kirby has been in custody since Oct. 20, 2025, eight days after his son’s death. His bond in the earlier case was set at $50,000.
Both parents remained in custody as of Tuesday, Oct. 20. Neither has been charged with homicide in connection with the child’s death.
